Terms of Service

These Terms govern your use of the eBike Marketing website and platform. By using the service, you agree to these Terms.
The service
eBike Marketing provides a done-for-you website, booking tools, and a Shopify storefront for e-bike dealers, set up through white-glove onboarding. Features and availability may change as we improve the platform.
Accounts and eligibility
You must provide accurate information and are responsible for activity under your account. You must be able to form a binding contract to use the service.
Fees
The platform is a one-time setup fee of $459 plus $95 per month. You may cancel anytime; your site, data, and connected accounts remain yours.
Your own messaging accounts
Customer-facing texts and emails from your site are sent through your own Twilio and Resend accounts, which you own and control. You are responsible for complying with the messaging rules and consent requirements that apply to messages you send to your customers.
SMS / Text Messaging Program
eBike Marketing operates an operational text-messaging program for authorized platform users — the platform operator and dealer staff. We use it to send account and service notifications such as new booking requests, new service leads, and system status. We do not send marketing or promotional text messages on this program, and we do not text members of the public.
How you opt in. You opt in only by entering your own mobile number inside your password-protected dashboard (operators under Settings, dealer staff under the Team tab). At that point the form states that, by saving a number, you agree to receive operational SMS alerts from eBike Marketing about account activity. No number is ever enrolled unless you enter and save it yourself.
Message frequency. Frequency varies based on your account activity. Message and data rates may apply.
Opting out and help. Reply STOP to any message to unsubscribe; you will receive a confirmation and no further messages. Reply HELP for help, or remove your number from your dashboard at any time. For assistance, contact support@ebike.marketing.
Your privacy. Mobile numbers and SMS consent collected for this program are never sold, rented, or shared with third parties for their marketing. They are used solely to deliver the alerts described above. Carriers are not liable for delayed or undelivered messages.
Acceptable use
Do not use the service for unlawful, harmful, or abusive purposes, to send unsolicited messages, or to infringe the rights of others.
Intellectual property
The platform software and our brand belong to us. Your content, brand, customer data, and connected accounts belong to you.
Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the three months before the claim.
Termination
You may cancel at any time. We may suspend or end the service for violation of these Terms or as required by law.
Changes
We may update these Terms from time to time. Material changes will be reflected by the "last updated" date above.
